Requesting Testing Information From Suppliers

Small Batch Manufacturer

The CPSC offers a benefit to small batch manufacturers (SBM) registered with them. This benefit allows for SBM to utilize supplier statements and lab reports for certain tests instead of testing everything on their own.

This registry is free, renews annually for free, and can save you a ton of money.

Use the questions below to help you when asking your suppliers for information.


Total Lead Content in Substrates of Children's Products

"Can you confirm that [product] has been tested, and passes, under CPSIA Sec 101a for Total Lead Content in Substrates to be used in children's products?"

You only need a statement of confirmation. This can be an email, letterhead, or other form that shows the line of communication indicating the product(s), the test(s), and the confirmation.

Lead in Paints & Other Similar Surface Coatings of Children's Products

"Can you provide a recent lab report for [product] that shows the test results of 16 CFR Part 1303 Lead in Surface Coatings? I do not need any proprietary information, that can be redacted. I only need what was tested, the date of testing, results of testing, and at what CPSC-accepted lab testing took place."

You must have a report from a CPSC-accepted lab that is no more than a year old. No exceptions.

Flammability of Wearing Apparel

"Can you confirm that [product] has been tested to 16 CFR Part 1610 and passes for use in clothing as a Class I or Class II material?"

You only need a statement of confirmation. This can be an email, letterhead, or other form that shows the line of communication indicating the product(s), the test(s), and the confirmation.
Note: This is only required if the fabric component is exposed to air when worn, has a raised surfaced, and is not made of exempted fiber content (acrylic, modacrylic, nylon, olefin, polyester, wool).

Heavy Elements in Children's Toys

"Can you confirm that [product] has been tested and complies with the Heavy Elements requirements under CPSIA Sec 106?"

You only need a statement of confirmation, a test report is better. This can be an email, letterhead, or other form that shows the line of communication indicating the product(s), the test(s), and the confirmation.
Note: This is only a requirement for certain toys intended for children under 6y.

Ban on Certain Phthalates in Certain Children's Products

"Can you confirm that [product] does not contain any banned phthalates in accordance to CPSIA Sec 108 and 16 CFR Part 1307.3?"

You only need a statement of confirmation. This can be an email, letterhead, or other form that shows the line of communication indicating the product(s), the test(s), and the confirmation.
Note: This requirement is for toys intended for children under 12y and child care articles intended for children under 3y.
